Can't be a hate crime, obviously, since Blacks cannot be racist. But...the victim is gay. But....the perps (excuse me: ALLEGED perps) are Wymyn of Color.

There's some really surprising comments from lawyers in that story. There's that one, plus:
- "what this really demonstrates is the idiocy of the hate-crime legislation,” said civil liberties lawyer Harvey Silverglate [who is this guy? he can't be from the ACLU]
- “Someone who is Jewish can be anti-Semitic,” said ACLU staff attorney Sarah Wunsch

And bonus non-lawyer-uttered dumb-assery:
- Carolyn Euell, 38, mother of two of the defendants...told reporters the alleged attack “can’t be hateful” because both her daughters are lesbians.

Lesbians and Gay men may be lumped together under the heading Homosexuals, but they are by no means the same thing. Democrats and Republicans get grouped together under the heading Political Parties, but they aren't the same thing either.

And sometimes, Militant Lesbians and Bitchy Queens just don't get along.
