I haven't yet heard conclusive evidence either way if this is a
1) Downloadable mod that alters the game code to make the pr0n
2) A mod that simply unlocks already existing content to be seen.
I've looked around, havent been able to clear it up, anyone know?
I know that 1) is not RS's fault, but 2) could be a problem for them.

What gets me is when you read reports about it the "outrage from parents over the sex scene in the game."
Seems to me if you are letting your kid play a game where they can deal drugs, shoot cops and innocents, run people over, and just cause mass death and destruction why would you be that upset over a blowjob or doggy style?

Ok, here is were I am stuck, from a legal issue.
The coding was there to begin with, but it was not able to unlock without modding.
By unofficially modding the game, aren't you commiting piracy and messing with the end-code... therefore voiding any obligation Rock Star games has to the content of said modding?

This is a bad analogy:
A car can be a weapon if used recklessly or with malicious intent. This does not make the auto maker liable for any deaths or injuries.
What a can of worms to open. Using the slippery slope argument, all product makers can be held liable for misuse of their product. All production halts to avoid litagation. We're back to the stone age.

Anything can be *misused* as a weapon. The key is *misused*.
I think the video game company would have a tough time arguing that the game was misused to show that scene. If that scene was built into the game, they did not put it there for any reason other than to be seen. So unless that video somehow enhances game play in some way, they could get in trouble for marketing a product that may be seen as illegal in some areas of the country.
